Minutes of May 13, 2020 – Supervisors

MINUTES OF MAY 13, 2020

The meeting was called to order at 7:00 P.M. by Chairman Dan K. Hogeland, commencing with the Pledge to the Flag.

Present:           Dan K. Hogeland, Chairman, Eric J. Weidman, V. Chairman, Scott D. Moyer, Supervisor, John D. Enck, Solicitor, and Lorie J. Kupp, Sec./Treas.

PUBLIC COMMENTS:

Tina Hedgepeth, 17 Newburg Dr. was present to request the Board consider changing the zoning ordinance to allow for chickens.  She provided the Board with a copy of Annville Township Zoning Ordinance which was changed in 2017 to allow for chickens with several requirements.  Board said they would have a look at it.

REPORTS OF ORGANIZATIONS:

Planning & Zoning Commission – minutes were received.  Zimmco Enterprises Lot Addition & PA DEP Sewage Planning Waiver & Non-Building Declaration were reviewed.  Plans signed.  Motion by Hogeland to accept the Sewage Planning Waiver and Non-Building Declaration for the Zimmco plan.  Seconded by Weidman.  All aye, motion carried.

Newmanstown Water Authority – minutes received.

MRJA – minutes and financial reports received.

Lebanon Co. TCC report received.

GLRA minutes received.

Police Activity report was received.

MINUTES:  April 8, 2020 & April 23, 2020 presented to the Board.  Motion by Weidman to approve April 8th & April 23rd minutes as printed.  Seconded by Moyer.  All aye, motion carried. 

SOLICITOR:

Pension plan ordinancesOrd. #051320A Police Pension Plan ordinance was presented to the Board for their consideration.  Motion by Weidman to enact Ordinance #051320A an ordinance of Millcreek Township, Lebanon County, Commonwealth of Pa. electing to amend its Police Pension plan administered by the PMRS pursuant to Article IV of the Pennsylvania Municipal Retirement law, agreeing to be bound by all provisions of the Pennsylvania Municipal Retirement law as amended as applicable to member municipalities. It is hereby ordained by Millcreek Township, Lebanon County as follows.   Seconded by Moyer.  All aye, motion carried.

Ord. #051320B Non-uniformed Plan Motion by Moyer to enact Ordinance #051320B Non-uniformed Pension Plan.  Seconded by Weidman.  All aye, motion carried.

Peachey holding tank correspondence – David & Mary Peachey, 165 Chapel Rd. need to replace their on-lot sewage disposal system.  A suitable soil area on site could not be located so the only option is to replace the malfunction with a holding tank.  He is placing soil fill that can be tested and used for an on-lot system after a 4-year period.  The Sewage Enforcement Officer, David Siminitus thought our holding tank ordinance required a maintenance agreement to be executed with the township.  Enck stated under DEP regulations it would not apply to this particular situation. Siminitis would like a letter from the Township stating that this ordinance does not apply to this situation and a permit can be issued by him.  Board instructed Solicitor to write letter.  Solicitor did suggest that perhaps the Board may want to look at updating the Holding Tank Ordinance because of changes at DEP as well as to require some type of Financial Security if a holding tank is being used and not maintained properly.

Flood Plain Ordinance – Solicitor reported on progress for hearing and proposed enactment of amendments to the Zoning Ordinance at the June meeting.

EXECUTIVE SESSION:  Motion by Hogeland to go into Executive Session. Seconded by Weidman.  All aye, motion carried.

Back in Session:  8:35 P.M.  Hogeland reported that the Executive Session was held on a personnel matter regarding an employee applying for both Worker’s Compensation and Unemployment Compensation.

ACTION: 

County Aid project $3892 was discussed.  Motion by Moyer to apply for the County Aid money in the amount of $3,892 for general maintenance on various roads.  Seconded by Hogeland.  All aye, motion carried.

Electric Purchasing contract through the Lebanon Valley Chamber of Commerce – proposals from AEP Energy were presented to the Board for review. Current contract expires 11/29/20.  24-month term – 4.674 c/kWh; 36-month term – 4.668 c/kWh. Motion by Weidman to enter into agreement with World-Kinect starting Nov. 2020 for 36 months at 4.668.  Seconded by Moyer.  All aye, motion carried.

UNFINISHED BUSINESS:

Recreation funding request to county planning ($42,000) was discussed.  Funds could be used for basketball court paving and constructing a parking area at Newburg recreation area. Motion by Weidman to apply to Lebanon County Planning for the recreational funding in the amount of $42,000 to be used for basketball court paving and parking area at Newburg play area.  Seconded by Moyer.  All aye, motion carried.

NEW BUSINESS:

Berks Copy Tech – Copier maintenance agreement renewal was reviewed.  Motion by Hogeland to take out the maintenance agreement for the copier in the office.  Seconded by Weidman.  All aye, motion carried.

PLGIT Proxy ballot – Secretary instructed to fill it out.

Memorial Park discussed in reference to flowers, etc. prior to Memorial Day.

BILLS/TREASURERS REPORT: Motion by Hogeland to accept the Treasurers Report and pay the bills as money is available.  Seconded by Weidman.   All aye, motion carried.

ADJOURNMENT:  Motion by Weidman to adjourn the meeting at 8:55 P.M.  Seconded by Hogeland.   All aye, motion carried.
