Minutes of April 10, 2019 – Supervisors


The meeting was called to order at 7:00 P.M. by Chairman Donald R. Leibig, commencing with the Pledge to the Flag.

Luke & Jennifer Horning, 6 Stricklerstown Loop Rd. were present to review an agreement with the Township for the removal of their current dwelling when the new house they want to build is finished.  Solicitor reviewed the agreement with the Horning’s and the Board.  Leibig asked those present if there was any public comment.  There being none, Hogeland made a motion to enter into the agreement with Luke Ray & Jennifer H. Horning to remove their dwelling after the new one is built. Seconded by Weidman.  All aye, motion carried. 


Recreation Board – minutes were received.

Planning & Zoning Commission – minutes were received.

Newmanstown Water Authority minutes were received. 

Police activity report was received.

Motion by Leibig to split the bid, to get our anti-skid from Pennsy Supply, and the 2A modified, the #4 aggregate, and the 9.5 mm wearing from New Enterprise. Seconded by Weidman.  All aye, motion carried.

 Resume Public Comment…..

Matt Shirk was present to introduce himself to the Board as a candidate for Lebanon County Commissioner.  Mr. Shirk stated that should he be elected he will be attending municipal meetings throughout the year.  Board thanked him for his attendance.

MINUTES:   Motion by Hogeland to approve as printed.  Seconded by Weidman.  All aye, motion carried.


ASA application from Elvin & Nancy Nolt – Solicitor reported on his research at the Assessment Office regarding the attached maps. Suggested that the land located in Richland Borough be handled the same way as the last time, by send a Letter of Understanding to Richland Borough and waiting the 180 days and then adopting a resolution.  Secretary questioned the application that was 9.3 acres?  Solicitor was also unsure and would have to look into that one further.  Motion by Hogeland to send Richland Borough a Letter of Understanding confirming the addition to the Township’s Agricultural Security Area after 180 days.  Seconded by Weidman.  All aye, motion carried.

306 Stricklerstown Rd. stormwater management issue was discussed in reference to an e-mail dated 3/22/19 from Zach Luciotti at Lebanon Co. Planning Dept.  His e-mail stated that the Stormwater Ordinance only covers any improvements that are submitted or approved on Land development plans.  Suggested this issue was a civil matter between two property owners.  Enck requested Zach cite the section of the ordinance he was referencing and hasn’t heard back from him since.  Solicitor again stated that the Board may have the legal authority to do what property owners are asking, but the Board does not have the legal requirement to do it.   Solicitor will follow up with Zach Luciotti.

Public Comment Policy – Jackson Township ordinance and resolution discussed.  Motion by Leibig to have Solicitor prepare a draft for review at the next meeting.  Seconded by Weidman.  All aye, motion carried. 


Soliciting permit ordinance # – Chief Hostetter was present to suggest that the Board consider updating the current Soliciting Ordinance #7 Sept. 4, 1968.  It was also suggested that the waiting period be extended to 3 days, as well as requiring an ID badge/permit be made so that it is worn and the residents are more aware.  Chief had sample ordinances from N. Lebanon Twp., and S. Heidelberg Twp.  He also had obtained quotes for an ID machine that ranged up to $1,700.  Board requested Solicitor work on a draft for the Chief and the Board to look at.


Basketball Court paving quote was discussed.  Leibig stated he thinks the cracks should be blown out and sealed before any paving takes place.  Leibig will contact Hackman paving about this.


County Aid project $3892 was discussed.  Motion by Leibig to use the County Aid money towards general maintenance on various roads.  Seconded by Hogeland.  All aye, motion carried.

NEW BUSINESS resumed….

Millcreek Community Group request for Use of Memorial Park for “Music in Memorial Park” was reviewed. Aug. 4, 11, 18 & 25th.   Motion by Leibig to give permission to Millcreek Community Group the use of the park on those four dates. Seconded by Weidman.  All aye, motion carried.

Berks Copy Tech – Copier maintenance agreement renewal was reviewed.  Motion by Leibig to take out the maintenance agreement for the copier in the office.  Seconded by Hogeland.  All aye, motion carried.

PLGIT Proxy ballot – Secretary instructed to fill it out.

2019 Paving projects budget quote from New Enterprise was reviewed.  E. Bethany Rd. from the wooded area (where we stopped 2 years ago) to S. Sheridan Rd. approx. 3480’ .67 of mile.  Motion by Leibig to advertise for bidding for E. Bethany Rd. roughly 3500’ an average of 22’ wide, a contractor will mill the notches to tie into the new roads, Millcreek Township will sweep the road, Contractor will tack, Contractor will place 2.5” of 19 mm <0.3 superpave and the contractor will seal it. Millcreek Township will provide traffic control. He has down here around 1300 Ton, we figured it out for around 1224 though, it is hard to say. And I’d also like on Bethany Road to be pulled in one pull, if possible. And then, on Stricklerstown Road, have approx., we can’t do the whole road, but I want to do through the wooded area there, and we would start there at , the street will be marked, I measured it, it will be  roughly about 1300’ which is what, what about a quarter of a mile or something. Roughly 22’ wide, now that can, also can be pulled in one pull if possible. Millcreek Township will provide traffic control. Millcreek Township will sweep. He had a budget quote for $74,000. So, we can’t if it comes in at $100,000 then you go add $74,000 on there, though I’d like to, we wouldn’t have any money left to do other road work or enough for the winter.  So, if you do through the wooded area that will be the ugly part that’s bad.  And uh, open the bids May 8th at 7:15 PM.  Seconded by Hogeland.  All aye, motion carried.   

Mower quotes – John Deere $41,000 through Costars, 5 yr. lease.  Binkley & Hurst $31,900 discussed. Replace the 1445 mower.

Art Wealand pay rate when not plowing was questioned.  PT CDL rate was approved.

BILL’S/TREASURER’S REPORT:   Motion by Leibig to accept the Treasurer’s Report and pay the bills as money is available.  Seconded by Weidman   All aye, motion carried.
