Organization and Regular Meeting

January 6, 2020

The meeting was called to order at 7:00 P.M. by 2019 V. Chairman, Dan K. Hogeland commencing with the Pledge to the Flag.

Dan K. Hogeland opened the floor for nominations for temporary Chairman.  Motion by Hogeland to nominate Eric Weidman for temporary Chairman.  Seconded Moyer.  There being no further nominations, nominations were closed.  All aye, motion carried.

Chairman 2020

Motion by Weidman to nominate Dan Hogeland as Chairman for 2020.  Seconded by Moyer.  All aye, motion carried.

Vice Chairman

Motion by Dan Hogeland to nominate Eric Weidman as Vice Chairman for 2020.  Seconded by Moyer. All aye, motion carried. 

Secretary Treasurer

Motion by Weidman to appoint Lorie Kupp as Secretary Treasurer for 2020.  Seconded by Hogeland.  All aye, motion carried.

Solicitor

Motion by Hogeland to retain the firm of Spitler, Kilgore & Enck P.C., John Enck as the Township Solicitor.  Seconded by Weidman.  All aye, motion carried.

Roadmaster

Motion by Weidman to nominate Scott Moyer as Roadmaster.  Seconded by Hogeland. All aye, motion carried. 

Road Foreman

Motion by Hogeland to appoint Donald Leibig as Road Foreman.  Seconded by Weidman.  All aye, motion carried.

Police Dept. Administrator

Motion by Hogeland to nominate Eric Weidman as Police Administrator.  Seconded by Moyer.  All aye, motion carried.  

Police Chief

Motion by Weidman to nominate Brian Hostetter as Police Chief.  Seconded by Hogeland.  All aye, motion carried.

Recreation Administrator

Motion by Weidman to nominate Dan Hogeland as Recreation Administrator. Seconded by Moyer. All aye, motion carried.  

Financial Consultant

Motion by Hogeland to retain the CPA firm of Garcia, Garman, & Shea P.C. as the Townships Financial Consultant for 2020.  Seconded by Weidman.  All aye, motion carried.

Township Engineer

Appointment of engineer discussed.  Secretary to contact Rick Bolt to discuss.

Vacancy Board

Motion by Weidman to nominate Ronald Weidman, Jr.  to serve as the Vacancy Board appointee.  Seconded by Hogeland.  All aye, motion carried.

Depository

Motion by Hogeland to retain Fulton Bank and PLGIT as the depositories of Township funds.  Seconded by Weidman.  All aye, motion carried.

Fulton Bank Resolution for new banking information was reviewed and presented to the Board.  Motion by Hogeland to adopt Resolution 1-6-20D with Fulton Bank for our checking accounts.  Seconded by Moyer.  All aye, motion carried.      Signature sheets also signed.  PLGIT check writing authorization sheet signed.

Equipment Rental

Fees were discussed.  Motion by Weidman to keep the equipment rental rates for 2020 the same as 2019. Seconded by Moyer.  All aye, motion carried.

Insurance Carrier

Motion by Hogeland to retain HA Thomson as the insurance carrier.  Seconded by Weidman.  All aye, motion carried.

State Convention

Attendance was discussed.  Secretary will get the documents on the convention for Moyer to have a look at.

Recreation Field Rent

Motion by Hogeland to keep the rental rates for 2020 the same as 2019.  Seconded by Weidman.  All aye, motion carried.

Office Hours

Motion by Weidman to keep the office hours at 7:30 A.M. to 3:30 P.M.  Seconded by Moyer.  All aye, motion carried.

Mileage

Motion by Hogeland to pay mileage according to the standard set by the IRS rate of ($ .575).  Seconded by Weidman.  All aye, motion carried.

Newmanstown Water Authority

Motion by Weidman to appoint Susie Harper, Carl Kreiner, and Robin Bomgardner to five-year terms.  Seconded by Moyer.  All aye, motion carried

Recreation Board

Motion by Hogeland to appoint Beth Garrison to another five-year term.  Seconded by Weidman.  All aye, motion carried.

Zoning Hearing Board

Motion by Weidman to re-appoint Robert Beisel to another three-year term on the Zoning Hearing Board.  Seconded by Hogeland.  All aye, motion carried.

Lebanon County EIT Tax Collection Committee Delegate

Motion by Hogeland to appoint Dean Moyer as the delegate to the Lebanon County EIT Tax Collection Committee.  Seconded by Weidman.  All aye, motion carried.

Recommendation to Auditors

2019 Budgeted rates: – per budget – Non-CDL $11.25 – $ CDL $15 per hour.    Motion by Hogeland to recommend to the Auditors that they set the working supervisors pay rates per the budget, Non-CDL $11.25 and $15 per hr. CDL.  Seconded by Weidman.  All aye, motion carried.

Employee Pay Rates Police per contract – Chief $36.72, Sergeant $33.01; Sec./Treas. $24.53; Road Crew $25.55, $20.00 & $17.50 per hr., mechanic $23.00; part time CDL snow plowing $17.50 & $ 23.69, non-CDL $11.25, Plowing Mountain incentive $1.50 per hr., PT laborer $13.00, PT CDL $15.50, Recreation $9.75, field maintenance $11; mowing $11; Part time police: flexible rate per Chief of Police up to yearly budgeted amount of $16,120.00.  Motion by Hogeland to establish the employees pay rates for 2020 as outlined in the budget.  Seconded Weidman.  All aye, motion carried.

Employee Benefit Plan

Motion by Hogeland to keep the Employee Benefit package Plan for 2020 the same as 2019. Seconded by Weidman.  All aye, motion carried.

Adjournment (Organizational)

Motion by Weidman to adjourn the organizational part of meeting at 7:28 PM.  Seconded by Hogeland.  All aye, motion carried.

The regular business meeting was opened at 7:29 PM. 

PUBLIC COMMENTS:  

John DeSantis commented that the Nov. minutes were not on the website as of yet.  Secretary will look into it.

REPORTS OF ORGANIZATIONS:

Police Activity report – 2019 Annual Report and Jan. activity report received.

MINUTESMotion by Hogeland to approve the minutes as printed.  Seconded by Weidman. All aye, motion carried.   (Moyer did not vote)

SOLICITOR:

Unpaid mowing bills – 124 N. Sheridan Rd., and 136 E. Main St.  – Solicitor reported on procedures for notification and collection per the ordinance.

PMRS new plan documents   notifying the township of the necessary steps in changing all plans to the new IRS-approved plan documents was discussed.   PMRS will be contacting the township to set a date for a conference call to discuss the revised plan documents and discuss different aspects of the plan.  Solicitor recommended that a Supervisor should be included in the call and perhaps Enck himself.  Eric will make himself available.

Executive Session:  Motion by Hogeland to go into Executive Session at 7:40 PM to discuss a personnel matter.  Seconded by Weidman.  All aye, motion carried.

Back in Session: 8:38 PM

ACTION:

Resolution 1-6-2020 Appointing Garcia, Garman, & Shea, PC to replace the elected auditors was presented to the Board for their consideration.  Motion by Hogeland to adopt Resolution #1-6-2020 appointing the certified public accounting firm of Garcia, Garman, & Shea, PC to replace the elected auditors of Millcreek Township.  Seconded by Weidman.  All aye, motion carried.

Resolution #1-6-20 A Waiving the Police Contribution for the year 2020 to their retirement plan was presented to the Board for their consideration.  Motion by Weidman to adopt Resolution #1-6-20A.  waiving the police contribution for the year 2020.  Seconded by Hogeland.  All aye, motion carried.

Resolution #1-6-20 B Setting the Non-uniformed pension Contribution rate for the year 2020 was presented to the Board for their consideration.  Motion by Hogeland to adopt Resolution #1-6-20 B.  Seconded by Weidman.  All aye, motion carried.

Resolution # 1-6-20C Appointments to the Lebanon County Appeals Board was presented to the Board for their consideration.  Motion by Moyer to adopt Resolution #1-6-20C Lebanon County Appeals Board member appointments.  Seconded by Weidman.  All aye, motion carried.

UNFINISHED BUSINESS: 

Pick up truck proposal briefly discussed and tabled.

Garage internet – tabled.

NEW BUSINESS:

Moyer informed the Board that Mr. Wise, a neighbor,  got some school children from a Mennonite school together today and they cleaned up a pile of tires and electronics dumped along the road.  He suggested the Township send a “Letter of Appreciation” along with a Gift Certificate from Justino’s in appreciation for the wonderful job they did to beautify the township.  Secretary will send a letter after receiving a name and address from Moyer.

Tomlinson Bomberger proposal for services was reviewed. Newburg Broadleaf weed control – $1,363.47, prepay $1,308.93.  Bagworm application $226.27 prepay $217.22.  Motion by Weidman to enter into the contract with Tomlinson Bomberger; one for Newburg broadleaf weed control prepay $1,308.93 and two the township bagworm spray at a prepay of $217.22.  Seconded by Moyer.  All aye, motion carried.

ELCO Youth Baseball request tabled until Rec Board advises.

Street Sweeping approved for Thursday April 30th and Friday May 1st.

Road Department job descriptions discussed.  Road Foreman, and road crew.  Secretary to contact N. Lebanon Township to request a copy of theirs.

BILLS/TREASURERS REPORT:   Motion by Hogeland to accept the Treasurers Report and pay the bills as money is available.  Seconded by Weidman.  All aye, motion carried.
