Minutes of Dec. 18, 2013 – Supervisors

MINUTES OF DECEMBER 18, 2013

The meeting was called to order at 7:02 P.M. by Chairman, Donald R. Leibig commencing with the Pledge to the Flag.

PUBLIC COMMENT:  none

REPORTS OF ORGANIZATIONS:

Planning & Zoning Commission – minutes were received.

Millcreek – Richland Joint Authority financial statements & budget analysis were received.

Newmanstown Water Authority – minutes were received.

GLRA – minutes were received.

Police Activity report was received.                                            

MINUTES:  Motion by Hogeland to accept the minutes as printed.  Seconded by Weidman.  All aye, motion carried. 

Recess: Leibig recessed regular meeting at 7:05 P.M. to convene hearing for the proposed amendment to the Zoning Ordinance.

Solicitor explained certain procedural requirements that must be met, and documents that must be put into the record of this hearing.  Secretary was instructed to place the following items in the hearing record:      

Exhibit 1 –        Certificate of Hand Delivery signed by Donald Leibig,  that he hand delivered a letter and a copy of proposed ordinance 121813 and Appendix G, to Planning Commission members on Oct. 24th & Oct. 25th.

Exhibit 2 –       Certificate of Hand Delivery signed by Lorie Kupp  stating that she hand delivered a letter from the Solicitor dated Oct. 24, 2013 and a copy of proposed ordinance 121813 and Appendix G, to Donald Leibig, Planning Commission member, Oct. 24, 2013.

Exhibit 3 –       Certificate of Hand Delivery signed by Catherine Kern certifying that she hand delivered, a Notice of Intent to Enact proposed Ordinance 121813, a Notice of Public Hearing, and a  copy of the full text of Proposed Ordinance 121813, and Appendix G  to the Lebanon Daily News on October 24, 2013.

Exhibit 4 –        Receipt signed by Kris Troup, Executive Director of the Lebanon County Planning Department, dated Oct. 24, 2013, acknowledging receipt of the full text of Proposed Ordinance 121813.

Exhibit 5 –       Acknowledgement of receipt from the Lebanon County Law Librarian, dated Oct. 30, 2013 for receipt of an attested copy of  the full text of Proposed Ordinance 121813.

Exhibit 6 –       Certificate of Posting, signed by the Township secretary certifying that the Notice of Public Hearing and Notice of Intent to Enact was posted at the township building

Exhibit 7 –        Proof of publication received from the Daily News for the Notice of Public Hearing – published as requested on Nov. 27, 2013 & Dec. 4, 2013.

Exhibit 8 –        Proof of publication received from the Daily News for the Notice of Intent to Enact Ordinance – published as requested on Nov. 20, 2013. 

Exhibit 9 –       Comments from the Lebanon County Planning Department dated Oct. 28, 2013.

Exhibit 10 –      Comments from the Millcreek Township Planning Commission dated Nov. 6, 2013.

Enck questioned if a copy of the ordinance was available from Oct. 25, 2013 through today?  Secretary answered yes.  Did anyone review the proposed amendment?  Secretary answered no. Solicitor gave a brief description of the proposed Zoning ordinance being considered this evening, The hearing was opened for comments or questions by those present.  Chairman Leibig adjourned the hearing at 7:18 PM and reconvened the regular meeting.

SOLICITOR:

Ordinance #121813 proposed zoning amendment – Section 16.14 Accessory Uses, Subsection A was presented to the Board for their consideration.  Motion by Leibig to adopt ordinance 121813 amending the Millcreek Township Zoning Ordinance Section 16.14 Subsection A.  Seconded by Hogeland.  All aye, motion carried.

Resolution #121813 D – Adopting a new official Zoning Map was presented to the Board for their consideration.  Motion by Leibig to adopt Resolution 121813 D  pertaining to the Millcreek Township Official Zoning Map.  Seconded by Hogeland.  All aye, motion carried.

ACTION:

Secretary presented the proposed budget for 2014 to the Board for their final consideration.  Motion by Hogeland to adopt Resolution #12-18-13  pertaining to the 2014 budget.  Seconded by Weidman.  All aye, motion carried.

Hydrant Tax Resolution #12-18-13 A was presented to the Board for consideration. Motion by Leibig to adopt Resolution #12-18-13 A pertaining to the Fire Hydrant Tax rate.  Seconded by Weidman.  All aye,  motion carried.066 mills for 2014

Resolution 12-18-13 B Street Light Tax rate was presented to the Board for their consideration.  Rates remain $.75 developed & $.19 undeveloped for 2014.  Motion by Leibig to adopt Resolution #12-18-13 B which pertains to our Street Light Tax.   Seconded by Hogeland.  All aye, motion carried.

Tax Levy Resolution was reviewed. Motion by Weidman to adopt Resolution #12-18-13 C, setting our real estate tax rate at 1.13 mills.  Seconded by Leibig.  All aye, motion carried.

UNFINISHED BUSINESS: none

NEW BUSINESS:

 CM High proposal for traffic light maintenance for 2014 was reviewed. ($398)  Motion by Leibig to accept

 the contract from CM High for the traffic light maintenance agreement for $398.  Seconded by

 Weidman.  All aye, motion carried.

YIS /Cowden Group – calibration prepay agreement was reviewed. $315  Motion by Weidman to accept the YIS/Cowden prepay agreement for calibrations.  Seconded by Hogeland.  All aye, motion carried.

Recreation Board resignation – Matt LehmanMotion by Hogeland to accept the resignation from Matt Lehman.  Seconded by Weidman.  All aye, motion carried.

John Binder complaint – parking of large vehicles in Newburg Village was reviewed.  Weidman will look into it.

Fire Co. request for 2014 was reviewed.  Jan. 10 & 11 Vendor Show; Feb 23 Spaghetti Dinner; March 9 Bingo; May 4 Bingo; May 4, 11, 18 & 25 Sunday Cookouts; June 6, 8, 15, 22 & 29 Sunday Cookouts; July 6, 13, 20 & 27 Cookouts; August 16 Vendor Show; Sept. 21 Pot Pie Dinner; Oct. 12 Bingo; Nov. 9 Bingo; Dec. 31 Fireworks, Womelsdorf; Zumba every Tues. & Thurs. Motion by Leibig to permit the Fire Co. and its auxiliaries to attend these events.  Seconded by Weidman.  All aye, motion carried.  

BILLS/TREASURERS REPORT:

Motion by Leibig to accept the Treasurers report and pay the bills as money is available.  Seconded by Weidman.   All aye, motion carried.

ADJOURNMENT: 

Motion by Hogeland to adjourn the meeting at 8:11 P.M.  Seconded by Weidman.  All aye, motion carried.
