Minutes of August 10, 2016

The meeting was called to order at 7:00 P.M. by Chairman Donald R. Leibig, commencing with the Pledge to the Flag.

PUBLIC COMMENTS:

Abner Peachy, 646 Stricklerstown Rd. was present to request an agreement with the township allowing him to live in his current home while building a new house. The agreement would require the old home to be torn down within 60 days of the occupancy permit being issued.  Solicitor instructed to proceed with drawing up the agreement.

REPORTS OF ORGANIZATIONS:

Planning Commission – minutes were received.

Newmanstown Water Authority – minutes were received.

Millcreek Richland Joint Authority – minutes and financial statements were received.

GLRA minutes were received.

PA Sate Police report received.

Police Activity report –was received.       

MINUTES:   Motion by Hogeland to accept the minutes as printed. Seconded by Weidman.  All aye, motion carried. 

SOLICITOR:

Attorney Peter Edelman was present on behalf of the Sewer Authority with the necessary paperwork for their bond refinancing. The township will be guaranteeing 70% of the bond, with an anticipated savings of approx. $600,000. Continuing Disclosure Certificate was explained.

Ordinance # 081016 Sewer Authority Guaranteed Sewer Revenue Bond was presented to the Board for their consideration. Motion by Leibig to adopt Ordinance #081016 pertaining to the Millcreek-Richland Joint Authority refinancing. Seconded by Weidman.  All aye, motion carried.  Additional documents signed; Debt Statement/Borrowing Base Certificate, DCED Application for Approval, Section 8110(b) Certificate, Report on Self-Liquidating Debt, and the Acknowledgement of Underwriter’s Disclosure letter.

Proposed zoning text and map amendments – Solicitor reported on the progress of the Municipalities Planning Code requirements needed to be completed prior to the hearing scheduled for Sept. 14th.

Karen Krater was present to report on the recent Planning Commission meeting and to discuss the proposed Eberly/Nye subdivision in regards to the Private Street Ordinance. Solicitor explained the Private Street Ordinance does not apply because this lot is not currently existing but is being created via the Lebanon County SALDO.

FINANCIAL CONSULTANT:

Bill Oyster was present with the Second Quarter financial statement & budget analysis.

ACTION:

Res.# 08102016 Non-uniformed pension contribution rate was presented to the Board for their consideration. Motion by Leibig to adopt Resolution #08102016 pertaining to the contribution rate for the non-uniformed pension. Seconded by Weidman.  All aye, motion carried.

UNFINISHED BUSINESS: none

NEW BUSINESS:

Borough of Womelsdorf – request for Fire Police – Aug. 28th – Ride for Freedom was reviewed.  Motion by Leibig to give Fire Police & whoever would want to go, permission to go to the Womelsdorf Ride for Freedom, Aug. 28th at 7:00.  Seconded by Hogeland.  All aye, motion carried.

BILL’S/TREASURERS REPORT: Motion by Leibig to accept the Treasurers Report and pay the bills, as money is available. Seconded by Weidman.  All aye, motion carried.
